BharatNetra Hackathon Terms and Conditions   


These are the terms and conditions (“Terms and Conditions”) governing your participation in the BharatNetra Hackathon organised by the Government of Odisha and GFTN Services (the “Organisers”) for the Integrated Global Financial Technology Capability Hub. Please read these Terms and Conditions carefully before registering for this Competition (defined below), as they will form a legally binding agreement between the Organisers and you. If you do not or if any member of your team does not accept these Terms and Conditions, you and/or your team will be disqualified and will not be eligible to participate in this Competition. By registering for and participating in this Competition, you and all members of your team confirm that you have read, understood, fully agree to and will unconditionally abide by these Terms and Conditions. 

In these Terms and Conditions, “we”, “our”, and “us” refers to the Organisers, and “you”, “your” or "yourself" refers to you as a participant of and/or applicant for registration for the Competition, and in relation to team shall include a reference to each member of your team.  

By continuing the registration as a Participant, you hereby agree that you or the entity represented by you have read and agreed to be legally bound by these Terms and Conditions, including the Organisers’ policies referred to herein, all as may be modified, added to, or updated from time to time, which will govern your participation in the Competition. 

If you do not accept these Terms and Conditions, you will not be able to submit your Solution and participate in the Competition.

  1. Definitions and Interpretation 
    • The following terms shall have the meanings ascribed below:  
      • Confidential Information” means, in whatever form:  
        • all non-public information disclosed, furnished or made available directly or indirectly by the Organisers to the Participant in relation to or in connection with the Competition or the Organisers;
        • all information, documents, drawings, manuals, materials, optical, flash and other storage media of the Organisers stamped or marked as “Confidential” or “restricted” or with other similar indicia and all other information designated by the Organisers as confidential either verbally or in writing, or should be reasonably understood as confidential given its nature and the circumstances in which it was disclosed; and
        • all copies and reproductions of all the types of information listed in Clauses 1(a)(i) and 1.1(a)(ii) and all communications between the Parties relating to such information. 
      • Competition” means the BharatNetra Hackathon organised by the Organisers and all activities associated therewith; 
      • IP” means all (a) copyright, trademarks and service rights, patents, trade secrets, utility innovations, geographical indications, domain names, layout design rights, registered designs, design rights, database rights, trade or business names and all other intellectual property rights or proprietary rights, (b) processes, methodologies, procedures, and trade secrets, (c) software, code, tools, scripts and machine-readable texts and files, and (d) literary work or other work of authorship, including documentation, reports, drawings, charts, graphics and other written documentation; 
      • Organisers” means the Government of Odisha and GFTN Services Pte. Ltd.;  
      • Party” means you or the Organisers, and “Parties” means you and the Organisers collectively; 
      • Participants” means all persons of the registered teams individually and collectively, that are participating in the Competition. “Participant” means each of the Participants; 
      • Portal” means the website for the uploading of the Projects and Solutions, and participating in the Competition, accessible at apixplatform.com;
      • Rules” mean the rules, regulations and decisions prescribed by the Organisers for the Competition including these Terms and Conditions set out herein and those accessible at the Website, or such other website(s) as may be specified by us from time to time; and 
      • Website” refers to the website for the Competition accessible at apixplatform.com.
    • Unless the contrary intention appears, in these Terms and Conditions: 
      • reference to “Clauses” or “Clause” shall refer to the clauses or clause of these Terms and Conditions and shall include all sub-clauses of the respective clauses being referred to; 
      • headings are inserted for convenience only and do not affect the interpretation of these Terms and Conditions; 
      • words importing the singular include the plural and vice versa; 
      • a gender includes all genders; 
      • references to persons are to be construed as references to an individual or a body corporate as the context requires; 
      • unless otherwise stated, one word or provision does not limit the effect of another; 
      • the words, “include”, “includes”, and “including” are to be read as if they are followed by the phrase “without limitation”; and 
      • any reference to any Act of Parliament includes any amendment, replacement or re-enactment to that Act and includes any subsidiary legislation made under that Act. 
  1. About the BharatNetra Hackathon 
    • This Competition is organised by the Organisers for Integrated Global Financial Technology Capability Hub. 
    • For this Competition, the Organisers have identified and published Problem Statements, details of which are available at apixplatform.com .
    • Individuals, entities and teams are invited to register as Participants, and develop technological solutions to these Problem Statements (“Solutions”).  
    • Participants are invited to submit the Solutions through apixplatform.com
    • The Portal is managed and provided by the Organisers.  
    • The use of the Portal is subject to these Terms and Conditions and the Organisers’ policy at https://gftn.co/privacy-policy.
  2. Competition Objectives 
    • The Competition seeks technology solutions to address the Problem Statements posted by the Organisers.  
    • The main objective of the Competition is to involve developers, innovators and startups, in highlighting the potential for innovative technologies to achieve those outcomes.  
  3. Team Participation 
    • Applications are open to all interested parties who can demonstrate, at the Organisers' request and to the Organisers’ satisfaction, their ability and track record of developing scalable technology solutions for the said Problem Statements. 
    • You must register and agree to these Terms and Conditions to participate in this Competition. Each Participant is to submit their team name, along with the other required details at apixplatform.com.
    • Each Participant shall ensure that all team members agree to, and complies with, the Rules (including these Terms and Conditions). 
    • the Organisers may, but is not obliged to, require you to take additional steps to confirm your team details (including the details required under Clause 2). 
    • Any breach of these Terms and Conditions may disqualify you from participating in this Competition.  
    • When exercising its rights of disqualification, the Organisers may at its sole and absolute discretion determine whether to disqualify you, one or more members of your team or your entire team. If certain member(s) of your team withdraw or are disqualified, the Organisers has the sole and absolute discretion to permit the remaining member(s) to continue participating in this Competition without the disqualified member(s), and without the right to replace any disqualified member(s). The remaining member(s) may also elect to withdraw from the Competition.  
    • Each Participant can be a member of only one team in the Competition.  
    • If your team wishes to withdraw from the Competition, please have each member of the team provide us with notice of such withdrawal in accordance with Clause 3. Any withdrawal from the Competition for any reason and/or unforeseen circumstances shall be subject to the Organisers’ written approval. 
  4. Compliance 
    • By registering for and participating in the Competition, you hereby agree to always fully comply with the Rules prescribed by the Organisers, as may be modified, added to or updated from time to time.  
    • All decisions made by the Organisers in relation to the Competition, including the award or non-award of prizes and other benefits, shall be in the sole and absolute discretion of the Organisers and shall be final and binding on all Participants. 
  5. Registration for the Competition  
    • To participate in this Competition, you must complete the registration process on the Website. If you are participating as a team, you must provide all relevant and necessary information for each member of the team during registration. 
    • By submitting the registration, you warrant and represent that all information provided by you for yourself and your team, during the registration process and your participation in this Competition, are accurate and complete. 
    • Registration for this Competition closes on 19 September 2025 23:59 IST (Odisha Time) (“Closing Date”), but subject to the Organisers’ discretion. 
    • Registrations received after the Closing Date will not be accepted by the Organisers.  
    • Except with the prior written consent of the Organisers, no amendments shall be made to any registrations (including the composition of any team) after the Closing Date.  
    • The Organisers is not responsible or liable in any manner whatsoever for any delay or failure to register prior to the Closing Date, including where such failure is from issues arising from any internet service providers, hosting provider or your equipment. 
  6. Conduct of the Competition 
    • Details, deadlines and other rules of the Competition will be published at apixplatform.com.
    • The language of the Competition shall be English. All materials and communications submitted in connection with the Competition must be in English.
    • The Organisers may, in their sole discretion, decide that a submitted Solution to a certain Problem Statement be reclassified or reassigned to another Problem Statement.
    • The final winning Solutions will be selected by, and in the sole and absolute discretion of, an expert panel organised by the Organisers (“Panel”). The decisions of the Panel shall be final and binding. No appeal shall be entertained in respect of the final decision by the Panel. 
    • At all times, Participants shall take all reasonable precautions to protect the integrity of and shall refrain from any use or divulgence any information, data, and/or solutions related to the Competition including, but not limited to: all files, technology solutions, records, documents, specifications, equipment, and similar items, whether the originals or copies were prepared by the Participant, other Participants or otherwise came into Participants’ possession. 
  7. Your Submission 
    • The Participants must complete the registration and proposal (hereinafter referred to as the "Project") submission process, in all aspects, by the stated deadline in accordance with these Terms and Conditions and the Rules of the Competition.  
    • The final submission must be registered and made available to the Panel via the Portal before the deadline published at apixplatform.com.
    • You warrant and represent that:  
      • you have all the necessary authorizations, permissions, rights, licenses and agreements to participate in the Competition and to all material used, that your participation in the Competition, and your submission of Solution(s) are in compliance with all applicable laws, rules and regulations;
      • your submissions, Projects, Solutions, etc., do not contain any malicious code, illegal, infringing or undesirable content or materials; and
      • your submissions, Projects, Solutions etc., do not infringe any rights, including intellectual property rights, of any third party.  
    • Except as set forth in these Terms and Conditions, the Participants shall participate in the Competition at their own cost. You acknowledge and agree that the Organisers will not and are not under any obligation to reimburse any costs associated with your participation in the Competition. 
    • The Organisers shall be entitled to retain possession of all Competition entries and any accompanying material submitted to it and the Organisers have no obligation to return such materials.  
    • You are permitted to use open source materials (“Open Source Materials”), provided that you (a) comply fully with all applicable terms and conditions of the Open Source Materials, (b) have the requisite rights and permission to use the Open Source Materials in your Solutions and the Competition, and (c) clearly indicate the specific Open Source Materials used as part of your Solutions and what role or part such Open Source Materials plays in your Solutions.  
    • You are solely responsible for confirming that your submitted Project and Solution is complete and for making and storing copies or drafts of it. The Organisers are not responsible for confirming the accuracy or completeness of a submitted Project, Solution, etc. received. The Organisers are not responsible for incomplete, late, misdirected, damaged, lost, illegible, or incomprehensible submitted Project or Solution. Proof of sending or submitting will not be deemed to be proof of receipt by the Organisers. Although the Organisers will make reasonable efforts to store and preserve the material residing on the Website and Portal, none of the Organisers are responsible or liable in any way for the failure to store, preserve or access user content or other materials you transmit or archive on the Website and Portal. You are strongly urged to take measures to preserve copies of any data, material, content or information you post or upload on the Website and Portal. You are solely responsible for creating back-ups of your user content. 
    • If the Organisers determine that your submitted Project or Solution has not been received, or has been erroneously deleted, lost, destroyed or corrupted, you may request the opportunity to resubmit your submitted Project or Solution. However, you must make such a request promptly after you know or should have known there was a problem. Your request will be handled at the sole discretion of the Organisers. 
  8. Participant Prizes 
    • The winning teams will each be eligible for prize money at a total of INR 5 Lakh before tax and any additional charges, but subject to the Organisers’ discretion. This prize will be provided only via wire transfer subject to the Organisers’ due diligence, KYC and AML checks of the recipient. Up to 3 winning teams may be selected.
    • The Participants and winning team shall not dispute the size or nature of the prize awarded, or demand different means of payment from the one specified, or seek exchange/replacement for any reason. The Organisers may, in their sole and absolute discretion, but shall not be obliged to, make available to the Participants other sponsored benefits, awards or prizes. 
    • The Participants hereby acknowledge and agree that the stipends and prizes referred to in these Rules will only be paid to the banking particulars provided by them to the Organisers, and the Organisers’ sole obligation in this regard shall be fully discharged upon transfer or transmission of the payment to the banking particulars and the Organisers are under no obligation to ensure that the same is received by the Participants. The Organisers are in no way responsible for the allocation or distribution of the stipends and prizes among the Participants. The Participants shall provide acknowledgement of receipt of the stipend, and where applicable prizes, by email to the Organisers within 3 days from the date of receipt of the prize. 
    • The winning team will be announced at apixplatform.com.
  9. Competition Portal 
    • Your use of the Portal is regulated by these Terms and Conditions and that platform’s Terms of Use at https://apixplatform.com/terms-and-conditions
    • You shall ensure that your use of the Portal and the Website: 
      • Complies with all applicable laws and regulations; 
      • Complies with any and all instructions, guidelines, directions, notices, operating rules and/or policies with respect to access to and/or use of the Portal, as may be issued and/or amended by the Organisers from time to time which are communicated to you or published on the Portal; 
      • Provides accurate information about you and accurately represents your work, gives credit to others when appropriate or required, and respects others’ intellectual property rights. 
    • We may, from time to time and without giving any reason or prior notice, upgrade, modify, suspend or discontinue the provision of or remove, whether in whole or in part, the Portal or any Project or Solution and shall not be liable if any such upgrade, modification, suspension or removal prevents you from accessing the Portal or any Project or Solution. 
    • We reserve the right, but shall not be obliged to: 
      • monitor, screen or otherwise control any activity, content or material on the Portal and in our sole and absolute discretion, investigate any violation of the Terms and take any action we deem appropriate; and/or 
      • report any activity that is or is suspected to be in violation of any applicable law to the appropriate authorities and to co-operate with such authorities. 
    • The Website and Portal may contain links to third party websites. Any such links are provided for your convenience only. We do not control those websites, and we are not responsible for their contents or practices, including their privacy practices. We do not endorse the operators of those sites, nor do we endorse or make any representations with respect to the contents of those sites or any products offered on those sites. 
  10. Prohibited Acts 
    • You shall not do any of the following (whether in connection with the Competition, the Solutions or otherwise): 
      • carry on illegal, immoral or unethical activities or behaviour of any kind; 
      • commercialise the Portal and/or any Project or Solution, including renting, selling, leasing, distributing or directly or indirectly charging others for use of the Portal and/or Project or Solution; 
      • gain unauthorised access to or otherwise interfere or disrupt other computer systems or networks connected to the Portal; 
      • gain unauthorised access to password-protected and/or secure areas of the Portal and/or to any other protected information, through any means not intentionally made available by us for your specific use; 
      • any form of collusion, cheating, coercion, or intimidation; 
      • any acts of sabotage, tampering, misuse, or attacks;  
      • impersonate any person or to falsely state or otherwise misrepresent your affiliation with any person;  
      • interfere with another’s utilisation and enjoyment of the Portal and/or the Content; 
      • use or upload, in any way, any software or material that contains, or which you have reason to suspect contains, viruses, damaging components, malicious code or harmful components which may impair or corrupt the Portal’s data or damage or interfere with the operation of the Portal or another’s computer or mobile device;  
      • misrepresent your identity, or your current or past work, education, skills, or qualifications; 
      • impersonate any person or entity, including, but not limited to the Organisers employee, fellow, past or potential Participant, or falsely state or otherwise misrepresent your affiliation with any person or entity; 
      • use or attempt to use or access another Participant or team’s submissions;  
      • disclose information about another person or entity, including your employer, that is confidential, or that you are not authorized to disclose; 
      • carry on any conduct that is harmful, threatening, abusive, harassing, defamatory, derogatory, libelous, invasive of another’s privacy, harmful to minors in any way, or hateful toward an individual or group of individuals based on religion, gender, sexual orientation, race, ethnicity, age, or disability; 
      • post or make available any content that:  
        • depicts hatred, is in bad taste, incites violence or is likely to incite violence, contains excessive vulgar or obscene language or excessive violence, contains pornography, obscenity or sexual activity; 
        • infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party; 
        • substantially duplicate’s another submitted Project or Solution previously entered in the Portal or otherwise any other Competition (by you or another Participant); 
        • constitutes or contains “affiliate marketing;” “link referral code;” “junk mail;” “tracking pixels or code;” “spam;” “chain letters;” “pyramid schemes;” unsolicited commercial advertising; or any other form of excessive, repetitive, and/or unsolicited messages to other users; 
        • contains malware such as software viruses, worms, or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; 
        • discloses personal information about another person such as their NRIC number, email address, telephone number, or address (street or box number); 
        • disrupts the normal flow of dialogue with an excessive amount of content to the Website and/ or Portal, or otherwise negatively affects other users’ ability to use the Website and/ or Portal; 
      • constitutes excessive use of site features, inconsistent with the intent and purpose of the Website and/ or Portal, and/or placing an undue burden on the running of the Website and/ or Portal, including but not limited to excessive registrations for the Competition; 
        • uses manual or automated software, devices, scripts robots, or other means or processes to access, “scrape,” “crawl” or “spider” the Website and/or Portal, or any related data or information; 
        • employs misleading email addresses, or forged headers or otherwise manipulated identifiers in order to disguise the origin of content transmitted through the Website and/ or Portal; 
        • disparages another person or any of the Organisers; or  
        • contains any other content or constitutes any other action, which in the sole judgment of the Organisers, is inappropriate or inconsistent with the purpose of the Website and/ or Portal; or  
        • any act that will bring the Competition, any of the Organisers or other Participants into disrepute. 
      • Any violations related to the above will result in immediate disqualification. The restrictions set out herein shall survive the termination of these Terms and Conditions. 
      • Where a clause permits the Organisers to disqualify you, the Organisers is entitled to, at its sole and absolute discretion, with immediate effect and without prior notice, terminate you and/or your team’s participation in the Competition. 
  1. Confidentiality  
    • Any Confidential Information is to be kept confidential by you and shall not be disclosed by you to any third parties (including any other Participant) without the prior written consent of the Organisers. You shall not use the Confidential Information for purposes other than to participate or compete in the Competition.  
    • Within ten (10) days of receiving notice from the Organisers, you shall promptly return or destroy (and verify in writing its destruction) all material embodying Confidential Information (in any form and including, without limitation, all summaries, copies and excerpts of Confidential Information and all electronic media or records containing or derived from Confidential Information). 
    • Confidential Information shall not include information that is in the public domain through no fault of or breach by you, and shall not include information already rightfully known by you without obligations of confidentiality prior to its disclosure to you by the Organisers. 
  2. Intellectual Property
    • Nothing in this Clause 13 shall affect the ownership or the right to license IP of any Party.  
    • You will retain ownership over any IP (including your Solutions) developed, created or generated by you prior to and during the Competition. By submitting any Project or Solution through the Portal, you hereby grant, and shall procure the grant of, an irrevocable, non-exclusive, worldwide, royalty-free, transferable licence on a non-commercial basis to the Project, Solution and underlying IP, for the Organisers to use in their planning, marketing, and promotion of current and future editions of the Competition and other affiliated events.  
    • The Website and Portal contain various information in the form of data, text, graphics, and other materials from the Organisers and our third party licensors (the “the Organisers Content”). You acknowledge that the Website and Portal and various elements contained therein are protected by IP rights, and that these worldwide rights are valid and protected in all forms, media, and technologies existing now and hereinafter developed. You also acknowledge that the Organisers content is and shall remain the property of the Organisers or its licensors. You agree to comply with all intellectual property laws, and you shall not encumber any interest in, or assert any rights to, the Organisers Content. You may not modify, transmit, participate in the sale or transfer of, or create derivative works based on any the Organisers Content, in whole or in part. 
    • The trademarks, service marks, trade names and logos (collectively, the “Trademarks”) used and displayed on each of the Website and Portal are registered and unregistered trademarks of ours or our licensors. All page headers, custom graphics, button icons, and scripts are service marks, trademarks and/or trade dress of the Organisers and may not be copied, imitated or used, in whole or in part, in connection with any product or service that is not authorized by us, in any manner that is likely to cause confusion among consumers, or in any manner that disparages or discredits us. The Trademarks used and displayed on each of the Website and Portal are and shall remain the sole property of us or their respective owners. Nothing in these Terms and Conditions shall be construed as granting, by implication, estoppel or otherwise, any license, ownership right, or right to use any Trademarks used or displayed on the Website or Portal. The misuse of the Trademarks displayed on the Website or Portal, or any other the Organisers Content on our Website or Portal, is strictly prohibited.
    • All rights are reserved. Unauthorized copying or use of any the Organisers Content or IP rights without the express written consent of the Organisers is strictly prohibited. 
    • Each of the Website and the Portal is controlled and operated by the Organisers. Our proprietary software, and our materials on the Website and Portal, including logos, trademarks, trade names, images, text, illustrations, audio, video files and the selection, coordination and arrangement of such materials, are protected by copyrights, trademarks, service marks, or other proprietary rights which are either owned by us or owned by other parties who have licensed their intellectual property to us, and all other trademarks, service marks, and trade names used on the Website and Portal are the property of their respective owners. 
    • While you are a Participant in the Competition, the Organisers grants you a non-exclusive, revocable, personal and non-transferable license, to use the Website and Portal, for your personal and private use, on a non-commercial basis and in compliance with the purposes of the Website and Portal. 
    • You are prohibited from any other use or exploitation of the Website and Portal, and their content, without the prior written permission of the Organisers. Notably, you are prohibited from: 
      • reproducing, adapting, distributing, publicly representing and disseminating the Website and/or Portal, and the contents of the Website and/or Portal; 
      • extracting or attempting to extract (notably using data mining robots or any other similar data collection tool) a substantial part of the data of the Website and/or Portal; 
      • copying, modifying, creating a derivative work of, reverse engineering, reverse assembling or otherwise attempting to discover any source code; 
      • modifying or attempting to modify the Website and/or Portal in any manner or form, except that you have the right to modify your self-generated content on the Website and/or Portal; 
      • framing or utilizing framing techniques to enclose any trademark, logo, or other proprietary information (including Competition descriptions, images, text, page layout, or form); 
      • using any meta tags or any other “hidden text” with the Organisers’ name or trademarks. 
    • Any unauthorized use by you which contravenes the above terminates the license granted by us. 
    • All new versions, updates or changes to our Website, Portal or related content shall be subject to these Terms and Conditions, as may be amended from time to time. the Organisers reserves all rights not expressly granted by the present Terms and Conditions. 
    • You shall not use the name of the Organisers, or an equivalent name or the logo of the aforementioned institutions for any purposes in any advertising, publicity releases, presentations, or publicly distributed documents, in whatsoever manner, without the prior written consent of its holder.   
    • Notwithstanding the foregoing, the Participants that submit the final winning Solutions may publish the fact of their participation in the Competition, provided that it is clarified that the Solutions are not endorsed or recommended by the Organisers. 
  3. Disclaimer of Liability  
    • Without prejudice and in addition to the Organisers’ rights, the Organisers shall not be liable to you or to any third party, for any losses, damage, expenses (including any direct or indirect, special or consequential damage, loss of income, revenue or profit, lost or damaged data, or damage to your device, software or any other property), whether: (a) arising out of or relating to the Rules (including these Terms and Conditions); or (b) in relation to or arising in connection with this Competition, including but not limited to your registration, participation, termination or disqualification in this Competition. 
    • By registering for and/or participating in the Competition, you hereby agree to assume all risks, and waive all rights to claim against any of the Organisers. The aforesaid disclaimers of liability shall apply regardless of whether Organisers have knowledge of the possibility of such losses or damages so disclaimed or otherwise, and regardless that these losses and damages are foreseeable, or otherwise. 
    • Your participation in this Competition shall be at your own risk and expense, and you shall (a) bear your own costs and expenses incurred in connection with the Competition, and (b) be solely responsible for providing all hardware, software and other relevant equipment. 
    • the Organisers reserves the right at its sole and absolute discretion at any time to postpone, cancel, terminate, modify or suspend the Competition without the need to provide any reason.  
    • the Organisers  further reserves the right at its sole and absolute discretion to disqualify any Participant who: (a) the Organisers  suspects or has reason to believe, has breached the Rules or any applicable laws and regulations; (b) the Organisers  suspects or has reason to believe, has committed any fraudulent, dishonest or other wrongful conduct; or (c) any other conduct that the Organisers  deems injurious or potentially injurious to the reputation of the Organisers  or the other Organisers (including without limitation any conduct that threatens the integrity or fairness of the Competition), without the need to give any prior notice. the Organisers shall have no liability or responsibility to any Participant affected by the aforesaid actions. 
    • The services, content, site and any software or other products or services offered by the Website and/ or Portal are provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied, including that the use of the Website and/ or Portal will (a) be timely, uninterrupted or error-free or operate in combination with any other hardware, software, system or data; (b) meet your requirements or expectations; (c) be free from errors, or that defects will be corrected; (d) be free of viruses or other harmful components. 
    • The Organisers disclaim all warranties, including, without limitation, warranties of title, merchantability, fitness for a particular purpose, non-infringement of third parties’ rights and any warranties arising from a course of dealing, course of performance, or usage of trade. In connection with any warranty, contract, or common law tort claims, to the fullest extent permissible under law, we shall not be liable to you or any third party, even if we have been advised of the possibility of such losses, damages, or expenses in any way, for any losses, damage, expenses (including any direct or indirect, special or consequential damage, loss of income, revenue or profit, lost or damaged data, or damage to your device, software or any other property), whether: (a) arising out of or relating to the Rules (including these Terms and Conditions); or (b) in relation to or arising in connection with this Competition, including but not limited to your registration and participation in this Competition, and/or access and use of the Portal. 
    • By using this Website, you acknowledge that the Organisers is not responsible or liable for any harm resulting from (a) use of the Website or Portal; (b) downloading information contained on the Website or Portal, including but not limited to downloads of content posted by users; (c) unauthorized disclosure of images, information or data that results from the upload, download or storage of content; or (d) the temporary or permanent inability to access or retrieve any content from the Website or Portal, including, without limitation, harm caused by viruses, worms, Trojan horses, or any similar contamination or destructive program. 
  4. Indemnity 
    • You agree to indemnify and hold the Organisers (the “Released Parties”) harmless from all claims, demands, actions, proceedings, liabilities (including statutory liability and liability to third parties), penalties, and costs (including without limitation, legal costs on a full indemnity basis), awards, losses and/or expenses, due to or arising out of: (i) any use of the apixplatform.com; (ii) your connection to the www.apixplatform.com; (iii) your participation in the Competition; (iv) your submission of the Solution(s); (v) your breach of any terms and conditions of these Terms and Conditions; (vi) your violation of any rights of another person or entity, including intellectual property rights; or (vii) your breach of any statutory requirement, duty or law. 
    • Without limiting the foregoing, the Released Parties shall have no liability to you in connection with: 
      • any incorrect or inaccurate information caused by the Organisers’ electronic or printing error, or by any of the equipment or programming associated with or utilized in the operation of the Website or Portal; 
      • technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines, internet connectivity or electronic transmission errors, or network hardware or software or failure of the Website or Portal; 
      • unauthorized human intervention in any part of the Website or Portal’s operation; 
      • Technical or human error which may occur in the administration of the Website or Portal; or 
      • any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from your use of the Website or Portal. 
  1. Amendment, suspension and termination 
    • The Organisers may at any time vary or amend these Terms and Conditions by posting the amended Terms and Conditions on the Website. If you continue as a Participant in the Competition after such amended Terms and Conditions have been posted, you will be deemed to have accepted the amended Terms and Conditions. You are advised to keep updated on such amendments and additions by visiting the Website. If you do not agree to the amended Terms and Conditions, you have the right to withdraw from the Competition. The Organisers may discontinue the Competition at any time and for whatsoever reason. You agree that the Organisers have the right at their sole and absolute discretion and without notice or liability to restrict, suspend, or terminate your participation in Competition, without assigning any reason. You are also responsible for ensuring that all persons who act on your behalf in the Competition are aware of and comply with these Terms and Conditions. If you do not agree to any amendments or additions to the Rules (including the Terms and Conditions), please withdraw from the Competition by giving us notice in accordance with Clause 21.3. 
  2. Bar from Participation 
    • Employees of any of the Organisers, or any of their subsidiaries, affiliates, or an immediate family member of any such employee are not eligible to participate in the Competition. 
  3. Personal Data 
    • The Organisers may be required to collect your personal data during the course of your registration and/or participation in this Competition. By registering for this Competition, you consent to the Organisers’ collection, use and disclosure of your personal data in accordance with the Organisers Personal Data Protection Policy, including for the publication of your photos or recordings on such media platforms that the Organisers may from time to time determine for the purposes of promoting or reporting on this Competition. For more information, please refer to the Organisers Personal Data Protection Policy here. The Organisers’ Personal Data Protection Policy will form part of these Terms and Conditions. 
  4. Governing law and dispute resolution 
    • These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Singapore. The Parties irrevocably agree that the courts of Singapore shall have exclusive jurisdiction to settle and adjudicate any dispute, claim, question or disagreement (“Disputes”) arising out of the Competition. The Parties irrevocably submit to the jurisdiction of courts of Republic of Singapore. Notwithstanding the aforesaid, the Organisers may at any time refer any Dispute to be finally resolved by arbitration in Singapore in the English language by a sole arbitrator in accordance with the Arbitration Rules of the Singapore International Arbitration Centre (“SIAC”) for the time being in force which rules are deemed to be incorporated by reference into this Clause. The seat of the arbitration shall be Singapore. The arbitrator shall be appointed by the President of the SIAC acting in accordance with the SIAC Rules. This arbitration agreement shall be governed by and construed in accordance with the laws of the Republic of Singapore. Neither the submission of a dispute to arbitration nor any other provision of these Terms and Conditions shall constitute a waiver, express or implied, of any of the privileges, immunities and exemptions which each of the Organisers enjoy in any relevant jurisdiction, which are specifically reserved. 
  5. Rights of Third Parties 
    • A person who is not a party to these Terms and Conditions shall have no right under the Contracts (Rights of Third Parties) Act 2001 to enforce any provision of these Terms and Condition
    • Order of Precedence: In the event of any conflict, inconsistency or ambiguity between or in any one or more terms in these Terms and Conditions (such as, without limitation, the other Rules and Personal Data Protection Policy), such conflict, inconsistency or ambiguity shall be resolved in favour of the Organisers and the provision or interpretation which is more favourable to the Organisers shall prevail. Notwithstanding any other term, the Organisers has the sole and absolute discretion to determine which term or interpretation is more favourable to it and such decision shall be binding on you. 
  6. Assignment 
    • You must not assign or sub-contract these Terms and Conditions.
    • We may assign, novate, transfer, or sub-contract the rights and liabilities in respect of these Terms and Conditions, without notifying you, without your consent, and without further reference to you. 
    • Notices to the Organisers: All notices, requests, demands and other communications required or permitted to be given or made under these Terms and Conditions or in connection therewith shall be given or made in writing and delivered by email to the Organisers at the email address referred to below (or such other email address as we may notify you from time to time): bharatnetra@gftn.com
  1. Independent Relationship 
    • Participation in this Competition is voluntary. You understand and agree that nothing in these Terms and Conditions may be construed as an offer or contract of employment with the Organisers or any of the other Organisers. Nothing herein contained shall be deemed or construed to create any employee/employer relationship, partnership, or an agency relationship between you and the Organisers or any of the other Organisers.
